Lumiar Institute is a non-governmental organization (therefore a non-profit organization) created by Fundação SEMCO, which maintains and funds the operation of its wholly-owned schools.


In this enterprise, the Lumiar Institute has established important partnerships. The most significant one is the partnership with the Education department of Microsoft Corporation’s subsidiary in Brazil. In 2003, Microsoft Corporation has launched a global initiative called "Partners in Learning" which, in 2006, created a global program called "Innovative Schools Program". This program selects innovative schools from all over the world and, in January 2007, twelve schools were chosen. Lumiar Schools from São Paulo and Lageado (an affiliated municipal school) were selected to be part of this program.

Become a partner of Lumiar Institute


Lumiar Institute has been trying to establish partnerships with municipal administrations across Brazil along the same lines of the partnership with the municipality of Santo Antonio do Pinhal, São Paulo state. Below is a template of the agreement that can be signed between the Institute and municipal administrations.


AGREEMENT by and between Lumiar Institute and the Administration of the Municipality of . . . to govern the cooperation between them.


LUMIAR INSTITUTE (Institute), nonprofit organization with social purposes, governed by private law, registered at the Ministry of Finance General Registry (CNPJ) under n. 05.830.217/0001-42, headquartered in the city of São Paulo, State of São Paulo, on Rua Bela Cintra n. 561, district of Consolação, CEP 01415-000, herein represented by the Chairman of its Advisory Board, Eduardo Oscar de Campos Chaves, Brazilian, teacher, bearer of ID Card (RG) n. 3.296.173, issued by the São Paulo State Secretariat of Public Security, and registered at the Ministry of Finance Individual Taxpayer Registry (CPF-MF) under n. 722.821.778-00, and


The Administration of the Municipality of  .... (Municipality), legal entity governed by public law, headquartered in the city of ..., on Rua .... , herein represented by its Mayor, .... Brazilian, ... [profession], bearer of ID Card (RG) n. ..., issued by the São Paulo State Secretariat of Public Security, and registered at the Ministry of Finance Individual Taxpayer Registry (CPF-MF) under n.....


WHEREAS


  • The Institute has developed a pedagogical proposal that includes a curriculum and methodology, and
  • The Municipality is interested in implementing this pedagogical proposal in schools of the municipal school system;
  • THE PARTIES ENTER INTO THIS AGREEMENT, under the terms of Municipal Law nº ... , according to the following clauses and conditions which they accept and undertake to perform, for the purpose of regulating and governing the cooperation between them.


Clause 1 – The Municipality entrusts the Institute with the responsibility for managing, from a pedagogical standpoint, the following schools which are part of the Municipality’s school system: ....
Sole paragraph – Pedagogical management of a school shall be understood as the responsibility for, provided the pertinent legal provisions particularly the Education Guidelines and Framework Act (LDBEN) and the Curriculum Standards (PCN) are observed, defining the school pedagogical plan which includes curriculum, methodology, assessment, organization and duties of education professionals and mechanisms to ensure democratic management.


Clause 2 – The Institute shall be responsible for:

  1. 1. Defining the pedagogical plan of the schools managed hereunder;
  2. 2. Coordinating the implementation of the pedagogical plan in the schools’ day-to-day activities, in compliance with the municipal, state and federal provisions that govern the matter. Such coordination should be entrusted to a qualified professional;
  3. 3. Training and providing advice to the other professionals of the school so as to enable them to implement the pedagogical plan defined in a satisfactory manner;
  4. 4. Overseeing and assessing the pedagogical work carried out by schools;
  5. 5. Proposing a yearly budget to the Municipality that covers costs associated with the pedagogical management of the schools as defined herein. Once it is approved, such budget shall become an Amendment hereto, and shall be incorporated to it for all purposes;
  6. 6. Preparing reports for the Municipality from time to time on the progress and status of the pedagogical work carried out in each school and on the use of funds received by the school.

Clause 3 – The Municipality shall be responsible for:

  1. 1. Allowing and creating conditions for the Institute to coordinate the pedagogical management of schools under the terms of this Agreement, and for giving the Institute freedom and independence as necessary for carrying out the activities provided for hereunder;
  2. 2. Assigning, to the Institute, for the purposes set forth herein and for the duration hereof, the right to use the school facilities, any furniture, equipment and material which are part of such facilities, in that the Municipality shall remain responsible for the maintenance of the facilities, and for the utilities such as electric power, water and sanitation, in addition to telephone and Internet access;
  3. 3. Maintaining and supporting the financial management and administrative structure of the schools covered by this Agreement, providing them with human and material resources and funding as necessary and as the Municipality has been doing since the creation of the school. The Municipality is also to continue paying any applicable salaries and payroll charges in connection with pedagogical, technical, administrative and support staff already allocated to the school;
  4. 4. Providing students with services such as school meals, transportation, uniform, didactic material, etc., pursuant to the applicable legal provisions;
  5. 5. Formally appointing the person who will be the Institute’s point of contact for issues in connection with the performance of this Agreement;
  6. 6. Transferring, on a quarterly basis, to the Institute, all the funds required to carry out the school pedagogical management pursuant to the yearly budget submitted by the Institute and approved by the Municipality.

Clause 4 – The maximum amount requested in the budget to be prepared by the Institute and approved by the Municipality will be R$ 100.00 (one hundred reais) monthly per school student, and the budget shall be calculated for 12 (twelve) months per year.


Clause 5 – Both the Municipality and the Institute reserve the right, upon approval of the other party and upon the execution of an Amendment hereto, to bring other institutions into the partnership which can contribute, with funding or otherwise, to the achievement of the objectives put forth herein.


Clause 6 – This Agreement comes into force on the date of its execution and has indefinite duration. It may, however, be terminated by any of the parties hereto upon written notice at least ninety (90) days in advance.


Clause 7 – Any omissions in the terms of this Agreement or divergence in its construction shall be bridged or resolved amicably by the parties. The ……. Central Court is hereby chosen to settle any disputes that are not settled amicably by the parties.


In witness thereof, the parties sign this agreement in the presence of two witnesses who also sign.

ATTACHMENT: MODEL BILL


"..., Mayor of the municipality of  ... , exercising the power conferred upon him/her, particularly under the provisions of the Organic Law of the municipality of ... ,


MAKES IT KNOWN that the Municipal Council Chamber has approved and he/she sanctions and enacts the following Law:


Article 1 – The Executive Branch is hereby authorized to enter into an agreement with Lumiar Institute, a nonprofit legal entity with social purposes governed by private law, pursuant to the draft agreement attached hereto and which is an integral part of this Law.


Article 2 – The agreement which is the subject matter of the previous article was designed to regulate and govern the implementation, in schools of the municipal system, of a pedagogical proposal developed by Lumiar Institute, which involves curriculum organization, learning methodology, assessment modes, organization and duties of pedagogical staff and democratic management mechanisms.


Article 3 – The expenses arising from this Law shall be covered by funds appropriately allocated in the municipal budget and supplemented as necessary in compliance with the Law.


Article 4 – This law enters into force on the date of its publication, and all provisions to the contrary are hereby revoked.
